1. Driver Information We Collect

To ensure sustainable employment and professional growth within the mobility sector, we collect:

  • Identity: Full Name, Surname, and Gender.
  • Contact: Phone Number and Email Address (Optional).
  • Location: Residential address to facilitate community-based recruitment.
  • Experience: Driving history to tailor our comprehensive training programmes.

2. Vehicle & Asset Information

For car owners seeking asset conversion, we collect data necessary for e-hailing compliance (Uber/Bolt) and fleet management:

  • Vehicle Specs: Make, model, year, and registration details.
  • Compliance Records: Roadworthiness certifications and insurance coordination data.
  • Performance Monitoring: Telematics and GPS data to ensure asset security and driver safety.

3. Security, Retention & Your Right to be Forgotten

We implement industry-standard security measures to ensure your data is stored on secure, encrypted servers and only accessed by authorized TopShayela staff.

Phase 01: Initial Application

At this stage, we only collect basic contact details. If you do not enter a formal partnership, you have the right to request the immediate removal of this data. Otherwise, we keep it for 12 months for future recruitment opportunities.

Phase 02: Formal Partnership & Activity Logs

Upon onboarding, your data moves from a "lead" to a "business partner" record. We are legally required to maintain a comprehensive log of your activities within the TopShayela ecosystem, including:

  • Operational Data: Trip logs, telematics, and vehicle performance history.
  • Financial Records: Payout history, earnings reports, and financial support services rendered.
  • Compliance & Safety: Accident reports, passenger feedback, and adherence to the Code of Conduct.
  • Relevant Data: Any other relevant data that the company deems necessary for operational or legal purposes.

These activity logs are kept for a minimum of 5 years to ensure transparency and legal compliance.

Safety Enforcement & Illegal Acts

In accordance with the POPI Act, TopShayela reserves the right to retain records indefinitely where it is necessary for the protection of the public or our business interests.

If a partner is found to have engaged in illegal activities, fraud, violence, or severe safety breaches, their identity details and the specific reasons for their termination will be moved to a permanent Safety Exclusion List.

This information is kept to prevent re-entry into the ecosystem and may be shared with law enforcement or regulatory bodies where legally required.

Long-term Records & Professional Integrity

After the 5-year legal retention period, TopShayela will minimize the data we hold. To protect our community and assets, we may permanently retain the individual's Name, Surname, and ID Number as a historical record of the partnership.

All other sensitive personal data—including phone numbers, residential addresses, and profile images will be securely deleted from our active systems.

This ensures we can maintain an accurate Safety Exclusion List while respecting your right to privacy.

Extended Retention Exceptions: Notwithstanding the above, TopShayela reserves the right to retain specific information for longer than 5 years if it is required for ongoing legal proceedings, insurance claims, or the maintenance of the Safety Exclusion List.

4. Third-Party Sharing & No-Advertising Policy

Your data is an asset for our partnership, not a product for sale.

Zero Sale of Personal Information

TopShayela will never sell, rent, or trade your personal information, contact details, or activity logs to third-party advertising networks or marketing agencies. We do not use your partnership data to serve you external advertisements.

We only share information with third parties when it is essential to fulfill our service to you. This includes:

  • Onboarding Partners: Sharing necessary documents with e-hailing platforms (e.g., Uber/Bolt) to activate your profile.
  • Safety & Insurance: Sharing telematics or incident data with insurance providers to process claims or emergency services.
  • Financial Institutions: Providing earnings data to banks or credit providers only when you request financial support or vehicle financing.
  • Legal Authorities: Sharing data only when we are legally compelled by a court order or SAPS investigation.

5. Financial Support & Monitoring

TopShayela provides Financial Support Services to prevent vehicle repossession and ensure a target take-home income. To do this, we monitor:

  • Earnings Data: To optimize operations and trigger financial assistance when necessary.
  • Operational Efficiency: Data-driven insights to maximize your earning potential on the road.

6. Your Rights (POPIA)

As a member of the TopShayela community, you have the right to access your data, request corrections, or ask for the deletion of your records once our partnership concludes and legal retention periods expire.
